ActivUP (hereinafter referred to as "We" or "ActivUP") is a company registered with the Commercial Court of Thonon-les-bains, whose registered office is at 125 route du fer à cheval 741600 Collonges-sous-Saleve.
ActivUP proposes to companies (hereinafter referred to as the "Company") to carry out playful activities between freely volunteering employees (hereinafter referred to as the "Employee") to encourage them to be more physically active. These activities are referred to hereafter as "Challenges".
The Challenge consists of collecting the physical activity of each employee via a mobile device and sharing it with other employees (whether or not they are participants) in real time.
On this occasion, information relating to Employees will be collected. This information will be referred to hereafter as "Personal Data".
Concerned about the protection of personal data, ActivUP is committed to protecting the confidentiality of the Data by complying with applicable data protection and privacy legislation, as well as the terms of this document.
Method of collecting consent
By participating in a Challenge, Employee indicates his or her consent to the terms of this document. If Employee does not agree with these terms, then Employee may refuse to participate in the Challenge.
Nature of the Personal Data collected
In order to carry out the Challenge, ActivUP will collect the necessary information from the Company or the Employee:
- the first and last name of the Employee,
- Employee's e-mail address,
- Employee's telephone number.
As he participates in the Challenge, the Employee will communicate in real time via a mobile device or manually:
- its number of steps
- the number of kilometers travelled
ACTIVUP has no knowledge of the Employee's geographical location at any time and therefore does not store or share this geolocation data.
Duration of the retention of Personal Data
We will store the Personal Information for as long as the Employee expresses a desire to participate in the Challenge. Once the Challenge is over, we will keep this information in our archives for a limited period of time necessary to answer any questions the Employee or the Company may have, but also for statistical purposes regarding the use of the Challenge. After that, we will delete all Personal Data, except for data that we may need to retain for legal reasons.
Use of Personal Data
Personal Data may be processed for the following purposes:
- Proper execution of the agreement made with the Company and satisfaction of its request regarding the successful organization of a Challenge;
- Statistical processing to develop and improve our services;
- To comply with legal requirements and/or in connection with requests from competent law enforcement authorities or other criminal or civil proceedings.
Sharing of Personal Data
The Personal Data such as first name, last name, distance and steps taken by the employee per day will be displayed in real time on the website dedicated to the Challenge.
We will not sell, rent or disclose Personal Data to unauthorized third parties without the Employee's express consent, except as otherwise expressly set forth below.
We may provide Personal Information to third parties who work on our behalf for the purposes listed above. These parties will not be permitted to use Personal Information for any other purpose, and we will require them to act in accordance with the terms of this Document and to use security measures to protect it.
Our services may be provided using resources located in various countries around the world. As a result, your personal data may be transferred to countries other than the country where you use our services, including countries outside the European Economic Area (EEA) that do not have laws providing specific protection for personal data or that have different legal rules on data protection, for example, the United States of America. Employees' right to their personal data
If the Employee wishes to know what Personal Data we hold about him or her, or wishes to complete, rectify, anonymise or delete such Personal Data that is incomplete, erroneous or obsolete, or if the Employee wishes us to cease processing his or her Personal Data, he or she may, where appropriate and in accordance with applicable law, exercise his or her rights by contacting us at the address below:

The Employee acknowledges that such a request may render null and void his/her participation in the Challenge.
Changes to this Privacy Policy
ACTIVUP may change this Privacy Policy or modify or discontinue access to this site at any time, with or without notice. However, if this Privacy Policy is changed in a material, adverse way, ACTIVUP will post a notice of such change. We recommend that Employees review this privacy policy frequently for any changes. Participation in the Challenge constitutes your consent to this Privacy Policy and any future changes.
